There is no regulation which defines joint ventures with all its aspects in Turkish Law. However, joint venture agreements having different features in conformity with the conditions and procedures determined by the legislation in force in Turkey, have been concluded intensively since 1980s. That is to say, in Turkish law, the regulations with regard to joint ventures arouse as a result of de facto implementations.

As joint ventures do not take part in Turkish law within a separate legislation, this concept does not have a unique definition and therefore there are different but similar definitions both in doctrine and judgments of Turkish Court of Appeals: In Turkish doctrine joint venture was described by a professor as “a partnership having or not a legal entity, established by two or more persons or companies having legal entity which are legally and economically independent from each other and managed jointly, in order to realize a common purpose and make profit”. According to another judge, joint venture is “a private co-operation of two or more persons who intend to make profit from a particular commercial transaction without establishing a partnership or a company having legal entity”. Turkish Court of Appeals also gave the definition of joint venture in one of its judgments. According to this, “joint venture is an enterprise or partnership realized by two or more enterprises having capital contribution, in order to serve in a particular sector or to realize a goal.”
